The Court of Appeals ordered the Directorate General of Civil Aviation (DGAC) and the company Aerogala to pay a compensation of more than 551 million pesos to the families of survivors and fatalities from plane crash happened between Puerto Montt and Chaiten in June 2005.
Unanimously error, the third room appellate court upheld the verdict against the company Aerogala SA and DGAC for injuries suffered by the passenger José Luis Rojas and relatives of the deceased Jose Francisco Feliú and Baeza.
The former director of the Air Club of Puerto Montt, Fernando Gunckel said recalling that unfortunate fact adding that the company then disappeared.
The ruling also confirmed the responsibility of the DGAC for lack of service by allowing the departure of the aircraft from the airfield of El Tepual, despite the unfavorable visibility conditions.
The amounts of compensation are broken down into 4,000 UF for moral damages and more than ten million in damages to be paid to José Baeza; two thousand 500 UF for each widow of those killed and two thousand UF for each of the 6 children.
